Resumo: Since the “origins of ancient cities”, was reserved for woman a destination of
oppression and subordination. Although shy and paused way, the enactments end by
narrating the trajectory of women. With the emergence of the 1916 Civil Code, the
famale figure is glimpsed as a mere object, to servisse and disposal of their
“masters”. There are various demonstrations of discriminatory treatment of women in
the Civil Code of Beviláqua, among them, the inclusion of women on the list of
relatively incapable, the need for acceptance and ratification of spouse for their acts
had validity in the civil sphere, the crippled performance the role of mother because
the paternal power was given to her only secondarily, giving the man the last word
about Family. Only in 1962, with the advent of the Statute of Married Women, the
famale figure was released of the male sovereign command and, from that moment,
numerous successive laws culminated with the enactment of Brazilian Federal
Constitution of 1988, seeking to ensure and enhance achievements that were
preceded huge fight by Brazilian women. Seeks to demonstrate that, at the time that
famales obtained emancipation and, consequently, the firmament of their rights, that
were referenced by Civil Code of 2002, the fight has just begun, because the women
that was before “marked by their sex”, as already predicted Simone de Beauvoir, now
become marked by secular struggle to raise the banner of equality, that will not
become depleted.
