Excesso de jornada de trabalho no futebol brasileiro: uma análise dos danos físicos e existenciais do atleta profissional futebolista

Abstract

The excessive working hours associated with Brazil’s most popular sport carry relevance and timeliness due to the growing number of matches played by professional footballers, who are subjects of rights and duties regulated by labor legislation and special laws. The research aimed to address labor overtime in football, linking it to physical and existential damages beyond the norm of the sport, as well as to define the footballer in their legal-social essence and understand the legal application of the aforementioned non-material damage to the professionals under study. To this end, the research is based on legislative, statistical, and scientific analysis, considering the dictates present in the current infra-constitutional law, as well as theories that seek to explain the occurrence of existential damage and the devaluation of the individual as a being with rights and deserving of respect. As a result, the incidence of excessive work hours can be seen in cases such as that of Spanish athlete Pedri González, as well as physical damages that affect the professional's existential sphere and the possibility of civil liability for the employing club regardless of fault. It is therefore concluded that the constant addition of matches in the Brazilian football calendar calls for a reduction in games, which should come from the national Confederation, the state federations, and, in the absence of action from these, from the national legislature.
