A regularização fundiária como instrumento garantidor do direito à moradia e sua aplicabilidade prática no município de Natal

Abstract

The Regularization emerged as the main guarantor instrument of the right to housing and combat social segregation historically arising from the industrial revolution, despite bring positive points regarding the country's economic growth has also brought negative points that hit the housing of the country concerned, because the disorderly occupation due to the rural exodus, the uncontrolled growth of cities and population growth resulted in the phenomenon of urban informality, the main factor justifying the settlement. The main laws dealing with the subject are federal laws 11.977/2009 and the Statute of the City, the main regulatory framework of the Brazilian urban policy. In Natal, Rio Grande do Norte, regularization is promoted by the Municipal Housing,Regularization and Structuring Projects - SEHARPE that, through land regularization projects that are currently in progress, search for solutions to the disorderly advance of existing illegal settlements in the Capital. The methodology used was literature through research in scientific articles, books, laws, the Constitution, as well as interviews and surveys with professionals in Rio Grande do Norte, which deal with the subject on a daily basis, bringing the search for a more qualitative field.
