Abstract

The following article will address the initiative of senator Fabiano Contarato in the bill of law No. 4.044/2020, created with the purpose of alleviating the negative effects in relation to the common disrespect on the right to disconnection, a concept created doctrinally to ensure the right effective to the rest of the employee. The project proposes to insert new articles in the labor legislation to mitigate the current effects of technological innovations invading labor relations. Therefore, the right to disconnection is intended to protect the human dignity of the worker as a human being in his/her intimate life, not allowing greater interference by the employer in his/her leisure. Considering this, the article presents about the modality of distance work, the institute of the right to disconnection and what are the possible impacts of the law initiative when it comes into force, listing possible solutions to improve the employee's situation that are greatly affected by the advance. technological, mainly in the mode of remote work.
