As crises migratórias e a ascensão dos movimentos neonacionalistas: uma análise socio-jurídica à luz do direito internacional

Abstract

Migration is a millenary phenomenon marked by a history of negligence and marginalization, which led to an unprecedented global migration crisis. In the 21st century, despite the existence of greater social, political and legal awareness on the subject, there are several hypotheses that cause this problem, not to mention the fact that the international community is still quite reluctant to support this cause. Among the most diverse factors of this reluctance, one that stands out is the rise of Neonationalist movements that have been hindering the inclusion of immigrants in new territories, acting in a racist, xenophobic, individualistic and anti-globalization way, not to mention, in addition to violating the Declaration Universal Human Rights and non-compliance with the Global Compact for Migration. This article aims, through bibliographic and documentary research, and scientific deductive and comparative methods, to carry out a socio-legal analysis in the light of International Law regarding the correlation between the global migratory crisis and the rise of Neonationalist movements. Thus, it was concluded that the rise of the Neonationalist ideology has been negatively affecting the situation of immigrants and contributing to their marginalization and, consequently, the worsening of migratory crises and generating a crisis in International Law, making this population group have several of their human rights and fundamentals violated. Therefore, it is essential that this situation is resolved, and it is up to the international community and the governments of each nation, together with its peoples, to accomplish this feat.
