Racismo institucional e sistema de justiça: uma análise do Tribunal de Justiça do Rio Grande do Norte

Abstract

The institutional racism through mechanisms not perceived by society, is responsible for maintaining practices of discrimination and racial inequality, allowing the black population to continue to find barriers to ensure racial equality. The central objective of this work is to analyze and evidence the presence of institutional racism in the Court of Justice of Rio Grande do Norte and how this hinders the fight against racism. It is proposed, based on the three-dimensional of racism seen from the individualistic, institutional and structural conceptions, to identify if these are present in the justice system of the State, based on the jurisprudential analysis of the judicial demands about racial crimes, as well as in the exposition of the circumstances relative to the black population in the State and in the Court, and to discuss about the legislation that criminalizes racism. Finally, it is verified the presence of institutional racism that results in the invisibility of the rights of this population, in the delay of jurisdictional provision and in the non-promotion of racial equality by the Court of Justice of Rio Grande do Norte.
