A evolução da proteção jurídica dos animais domésticos

Abstract

This work aims to investigate the evolution of Animal Rights from its origin to the present day through a historical analysis of its evolution in our Brazilian legal system. Since it is indisputable that animals have accompanied man throughout his journey through history, and all his legal evolution, including the important conquest of rights, and why would non-human animals not be the objective of this historicallegislative evolution? Despite not having our rationality, non-human animals, according to scientific studies, have the ability to feel and a certain degree of cognition, which makes them susceptible to suffering. Therefore, such living beings deserve to be protected by national legislation, having their rights protected and their dignity protected. Thus, the present work aims to identify and investigate how the protection of rights related to non-human animals has been progressing, and the legislative evolution towards this specific group, with the scope of historicizing all this historicallegislative evolution in order to identify possible improvements to guarantee the dignity of this specific group. It is a research of historical procedure, developed through the comparative method, starting from the analysis of an entire legislative evolution, in order to compare with the current reality and application of these norms.
